Dani Alves, who was arrested on January 20 after being accused of an alleged sexual assault committed at the Sutton nightclub in Barcelona on December 30, is still being held without bail in the Brians 2 prison.
His lawyer, Cristobal Martell, can file an appeal by January 31 to request the provisional release of the former Barcelona right-back.
Nightclub activated the protocol against macho violence
Mayka Navarro has reported that Alves spent 16 minutes in the toilet with the alleged victim, also claiming that it was the nightclub's bouncer who activated the protocol against male violence.
"I asked her 'But what happened to you? Tell me what happened to you! You have to calm down'," the bouncer told the police.
"But she was very overwhelmed."
According to El Periodico, the woman claimed it was Alves who "forced her to sit on top of him, threw her to the floor, forced her to perform oral sex which she actively resisted, slapped her, lifted her off the floor and penetrated her until he ejaculated".
The woman was taken to the Hospital Clinic in Barcelona, where she was examined for intercourse evidence.
This is how Alves behaved after the incident
El Periodico also revealed that before leaving, and after the alleged sexual assault, Alves asked for a last drink at the bar.
Meanwhile, La Vanguardia indicated that Alves left the nightclub crossing paths with the woman, who was crying and whom he ignored.
What penalties is Alves facing if he's found guilty?
According to the victim's statement, which the investigating judge considers "forceful and persistent", Alves forced her to a bathroom located in a VIP area of the Sutton nightclub in Barcelona on the night of December 30 to 31.
After the last legislative modification, the new law dictates that penalties range between four and 12 years in prison when the assault includes intercourse vaginally, anally or orally.
